EU Trademark Registration Benefits

EU trademark registration gives applicants a number of benefits. A trademark is the symbol that customers use to pick the brand owners out. It distinguishes you from your competitors. You can protect and build upon your trade mark if you register it. The European Union Intellectual Property Office (EUIPO) is responsible for supporting innovation by managing trademarks and designs within the European Union.

A European Union trade mark (EUTM) grants you exclusive rights in all current and future Member States of the European Union through a single registration, filed online. It is valid for 10 years and can be renewed indefinitely, 10 years at a time for each renewal. Benefits of Registering EU Trademarks
EUTMs essentially offer the same benefits as do national trademarks. EUTMs protect the rights of owners to use their marks in commerce. Some of the advantages are as follows:

(1) The costs for the registration of a Community Trademark are lower;
(2) EUTMs are valid across the entire European Union member countries without the need for reapplication in the event the EU enlarges;
(3) There are a wide range of marks can be registerable;
(4) It is possible to include up to three classes of the International Classification of trademarks at the same price;
(5) The process is fast, if there are no objections (risk that can be minimized with a trademark viability study), trademark is granted in about 8 months from the date of the application;

For enterprises whose transactions are limited to a single area, registering for a national trademark may prove to be more beneficial as it can be more easily managed by a country attorney. However, if the business activities may be expanded to other jurisdictions within the European Union, an EUTM is much more recommended.

Types of Registerable Trademark
1. Word mark
A word mark consists exclusively of words or letters, numerals, other standard typographic characters or a combination thereof that can be typed.

2. Figurative mark
It is a trade mark where non-standard characters, stylisation or layout, or a graphic feature or a colour are used, including marks that consist exclusively of figurative elements.

3. Figurative mark containing word elements
A figurative mark consisting of a combination of verbal and figurative elements.

4. Shape mark
A shape mark consists of, or extends to, a three-dimensional shape. It can include containers, packaging, the product itself or its appearance.

5. Shape mark containing word elements
A shape mark that contains verbal elements.

6. Position mark
A position mark consists of the specific way in which the mark is placed or affixed to the product.

7. Pattern mark
A pattern mark consists exclusively of a set of elements which are repeated regularly.

8. Colour (single) mark
A colour single mark is just that - a trade mark which consists exclusively of a single colour (without contours).

9. Colour (combination) mark
A trade mark which consists exclusively of a combination of colors (without contours).

10. Sound mark
A sound mark consists exclusively of a sound or a combination of sounds.

11. Motion mark
A trade mark consisting of, or extends to, a movement or a change in the position of the elements of a mark.

12. Multimedia mark
It consists, or extends to, the combination of images and sound.

13. Hologram mark
This is a new category of trade mark (as and from 1 October 2017). Hologram marks consist of elements with holographic characteristics.
