Malaysia Trademark Registration Requirements

Malaysia trademark registration is filed with Intellectual Property Corporation of Malaysia (MyIPO). Trade mark is a sign which distinguishes the goods and services of one trader from those of another. A mark includes a device, brand, heading, label, ticket, name, signature, word, letter, numeral or any combination of these. Once registered, the mark is valid for ten years from the date of application and may be renewed every ten years. The following are the relevant requirements. 

Non-registrable Trademark
1. Prohibited Marks
If the use of which is likely to confuse or deceive the public or contrary to law.

2. Scandalous or Offensive Matter
If it contains or comprises any scandalous or offensive matter or would not otherwise be entitled to protection in any court of law.

3. Prejudicial to the Interest or Security of the Nation
Registrar bears the responsibility of determining the trade mark, whether it might be prejudicial to the interest or security of the nation. It may be that a mark contains an inflammatory statement or words.

Conditions on Applicant
Any person who is the owner of trade mark using the trade mark or proposes to use the trademark may apply for registration in Malaysia. The owner may be an individual, partnership, company or organization.

Required Materials for Application
A filing date is accorded to the date of receipt of the application if the application contains all the following information/documents:
(1) Name and address of the applicant;
(2) A representation of the trademark;
(3) A list of the goods or services to be covered by the trademark registration;
(4) The International Classification applicable to the goods or services;
(5) Statutory Declaration declaring that applicant is lawful proprietor of the mark applied for;
(6) Where a trademark contains any word or words in a language or alphabets other than the Malay or English language/alphabets respectively, then a certified translation and transliteration of the mark applied for is required.
