Trademark Registration in Azerbaijan is one way to protect your trademark in the country. Azerbaijan is a member of the Madrid Agreement and Madrid Protocol. If you just want to register your Trademark in one country, it is sufficient to apply for a national registration at the local trademark office. If you already have filed a trademark application or have a trademark registration in one or more countries of the Madrid Union (based on the Madrid Agreement and Madrid Protocol), you can obtain trademark protection by filing one single application, so called International Registration (Madrid System). Foreign applicants must be represented before the Office by a registered Azerbaijani trademark attorney.

Required Information
For registration of a trademark the following date shall be duly provided:
1. Applicant’s name, address and nationality, country 
2. At least one representation of the mark (in color if claimed + indication of claimed colors);
3. List of goods/services;
4. Priority data (if priority is claimed)application;
5. Power of Attorney, signed by the applicant (position in the company of the person authorized to sign is required to be indicated) and provided with company’s seal or stamp, no notarization or legalization.

Procedures for Trademark Registration in Azerbaijan
After the completion of filing, the official notification of the receipt of the application is issued within 3 months. The Azerbaijani trademark application undergoes substantive examination for about 4-5 months. On condition that the trademark meets the requirements of protectability, the grant decision is issued. After payment of the registration fee, the certificate of registration is issued within 3-4 months.

Generally, the entire procedure of trademark registration in Azerbaijan takes from 12 to 18 months.

Validity and Renewal
The trademark in Azerbaijan is valid for ten years from the filing date. A trademark may be renewed for successive periods of ten years within twelve months before the expiration date. It is possible to renew a trademark within a grace period of six months after the expiration date on condition that a surcharge is paid. Reinstatement of a lapsed trademark after grace period expiration is not possible.

Duly note, if the trademark has not actually been used seriously for a period of 5 years after filing the application, or if the use has ceased for more than 5 years, the trademark may be subject to cancellation.
