Kyrgyzstan Trademark Registration

Kyrgyzstan trademark registration is one of Tannet’s worldwide intellectual property services. The trademark applications must be filed with the State Service of Intellectual Property and Innovation of Kyrgyzstan. It is not necessary for a trademark to be in use in Kyrgyzstan in order for it to register. In Kyrgyzstan, trademark registration is mandatory to be granted rights over a trademark, as it is a "first to file" jurisdiction. If a third party intends to register or use a trademark for similar goods or services that includes a primary or distinct part or portion of your trademark, you will have the right to file cancellation actions against the mark. Foreign applicants must be represented before the Office by a registered Kyrgyz trademark attorney.

Required Information
1. Name and address of the applicant;
2. Prints of the trademark;
3. List of goods and/or services in accordance with the international classification;
4. Certified copy of priority document if priority is to be claimed;
5. Signed Power of Attorney (legalization and notarization are not required).

How to Register a Trademark in Kyrgyzstan
After filing the application, the Kyrgyz trademark application undergoes formal examination within 4 months. Substantive examination is conducted within 9-10 months. After completion of the substantive examination the grant decision is issued. After payment of the registration fee the certificate of registration is issued within 2-3 months.

Roughly, the entire procedure of trademark registration in Kyrgyzstan takes from 14 to 17 months. Although a trademark does not have to be in use in order for it to register, it must not go unused for more than three years after registration or it will become vulnerable to cancellation actions based on lack of use of the trademark.

Trademark Validity and Renewal
A trademark in Kyrgyzstan is valid for 10 years from the date of filing and can be further renewed every 10 years. In Kyrgyzstan it is possible to apply for a renewal within 12 months before the deadline. There is also a 6-month grace period which allows applying for a renewal after the deadline upon payment of a stipulated fine. Reinstatement of a lapsed trademark (after expiration of a grace period) is not possible.
