Trademark Registration in Kazakhstan

Trademark registration in Kazakhstan is filed with the State Register of Trademarks of the Republic of Kazakhstan. A trademark is a mark used to distinguish goods (services) of certain legal entities or individuals from similar goods (services) of other legal entities or individuals. Visual, verbal, alphabetic, numeric, three-dimensional and other marks or its combinations may be registered as a trademark.

Trademarks legal protection in the Republic of Kazakhstan is granted on the basis of state registration, as well as without registration due to international treaties of the Republic of Kazakhstan. The owner of the trademark has the exclusive right to use and dispose of the trademark belonging to him in regards to the goods and services indicated in the certificate. No one can use the trademark protected in the Republic of Kazakhstan without the owner’s consent.

Required Documents
(1) Full name of applicant and legal address of applicant;
(2) Image of the mark in JPEG format;
(3) List of goods or/and services indicated in Classes of International Classification (Nice Classification) of Goods and Services;
(4) Power of Attorney which must be signed by an authorized person and sealed. If the applicant has no company seal/stamp, the Power of Attorney must be notarized;
(5) a certified copy of the priority application if convention priority is claimed.

Registration Procedure
After filing the application, the State Register of Trademarks starts the preliminary examination stage which shall be carried out within a period of two weeks from the date of application filing which verifies the application content and the presence of the necessary documents.

The stage of substantive examination shall be carried out within the period of 7 months from the date of filing an application. On results of the substantive examination the grant decision is issued. After payment of the prescribed registration fee, the certificate of registration will be issued accordingly.

Generally, it might take 9-11 months from filing the application until registration, publication and issuance of an official Extract from the Trademark Register.

Trademark Validity and Renewal
The Trademark Registration is valid for 10 years from the date of filing an application. The term of the trademark registration can be extended each time for the next 10-year period during the last year of a trademark validity period or within 6 months after expiration of the validity period (with payment of restoration fee).
