China Trademark Registration Requirements and Process

China trademark registration adopts “first-to-file” principle, which means the earlier you file the application, the better it will be. Trademark is the brand of a product that we often say. It is a kind of identification mark to identify the source of goods (or services). Characters, figures, letters, numbers, three-dimensional signs and color combinations, or combinations of the above elements, can be used as trademarks. Trademark registration is regional and registered in mainland China is protected only in mainland China. Below are the registration requirements and procedures.

China Trademark Registration Requirements
The State Intellectual Property Office (SIPO) is the registry responsible for registering and providing all mark requirements in China. For a mark to be registered, it must be available and not already registered with the Registry database, and it must be capable of graphical representation. Typically a China trademark will be in the form of words, symbols, numerals, letters or designs but it must not be of a descriptive nature.

Foreign applicants without residency or place of business in China are required to submit trade mark applications through a local Chinese trade mark agent who will deal directly with the SIPO.

2. Individual Applicant: Identity documents and address proof

China Trademark Registration Process
1. Trademark Search
Before filing the application, it is recommended to search for the trademark in order to avoid the conflict trademarks that may lead to the refusal.

2. Submit the application
Foreign applicants without residency or place of business in China are required to submit trade mark applications through a local Chinese trade mark agent who will deal directly with the SIPO.

3. Examination
After the SIPO determines that you have met the minimum filing requirements, the application is forwarded to an examining attorney. This may take a number of months. The examining attorney reviews the application to determine whether it complies with all applicable rules and statutes.

4. Opposition
After acceptance, a trademark application will be published for opposition in the official bulletin. The opposition period is 90 days.

5. Registration
If there is no opposition after the statutory period of 3 months from the date of publication, the  Certificate of Registration will be issued.
