Pakistan trademark registration is on the legal basis for Trademarks in Pakistan is the new Trademark Law “Trade Marks Ordinance No. XIX” of 2001, in force since April 12th, 2004. To obtain trademark protection in Pakistan, the trademark will need to be registered. The trademark registration system in Pakistan follows the “First to use” jurisdiction, which means that prior use of a trademark establishes right to a mark.

Who Can Apply?
In Pakistan an application to register a trademark can be filed by either the applicant themselves, or by a trademark attorney. However, the applicant can only file the trademark application if they are a citizen of, or are living in Pakistan. Same goes for the trademark representative or attorney, they can only file a trademark application for the applicant, if they are a citizen of, or are domiciled in Pakistan. Furthermore, to complete a trademark application, a power of attorney (POA) is needed.

Filing Requirements
Basically, the following documents and information are required for filing a trademark application in Pakistan:
(1) an application for registration containing:
(2) a request for registration of a trademark;
(3) the full name and address of the applicant;
(4) a statement of goods or services in relation to which it is sought to register the trademark;
(5) an international classification of goods or services;
(6) a representation of the mark.

Process for Trademark Registration in Pakistan
1. Search for trademark before filing of application of trademark registration.
2. Submission of application to the intellectual property office for trademark registration.
3. Initial review from Registrar of Trademark registration application.
4. Appearance before registrar by applicant/representative in case of objections from registrar of trademarks.
5. Issuance of order by the registrar for publication of trademark in Trade Journal of Pakistan by the registrar of trademarks.
6. Publication of trademark in the Trade journal of Pakistan;
7. Trademark Registration certificate issuance (if there is no objection).

In Pakistan, the complete trademark application process, from filing an trademark application to registration takes about 18-24 months.

Validity and Renewal
Once registered, the validity period for trademark registration in Pakistan is 10 years. A trademark registration is valid for 10 years from the date of application. The registration is renewable for periods of 10 years. If the trademark has not been used within 5 years from the date of issuance of registration certificate, it may be subject to cancellation upon request of any interested party. Subsequent use of the trademark can restore protection if no party has requested cancellation due to non-use in the meantime.
