China Patent Application

China patent application is one of Tannet's intellectual property services. A patent is an exclusive right granted for an invention, which is a product or a process that provides, in general, a new way of doing something, or offers a new technical solution to a problem.

1. A patent provides for the owner:
A patent provides protection for the invention to the owner of the patent and that protection means that the invention cannot be commercially made, used, distributed or sold without the patent owner's consent. These patent rights are usually enforced in a court, which, in most systems, holds the authority to stop patent infringement.

2. Types of a China Patent
A.Invention Patent: As in Europe, in China an invention patent is granted for new technical solutions or improvements to a product or process, provided that the technical solutions have a practical applicability.
B.Utility Model Patent: the shape or the structure of the product or the proposed applicable new technical plans developed from the combination of both.
C.Design Patent: the shape, pattern, color of the product, or the new design which is applicable and may arouse aesthetic sensibilities developed form the combination of them.

3. Required Documents and Information
1) Invention Patent:
A. Name of the invention;
B. Name and address of the applicant;
C. Name and address of the inventor;
D. Patent documents

2) Utility Model Patent
A. Name of the invention;
B. Name and address of the applicant;
C. Name and address of the inventor;
D. Patent documents.

3) Design Patent
A. Name of the design;
B. Name and address of the applicant;
C. Name and address of the designer;
D. Drawings of the designed product;
E. Brief description of the appearance design.

4. The patent documents include:
A. Claim: describe the protection scope of the patented technology.
B. Abstract: provide the outline of the key technical aspect of the patent.
C. Specification: provide written details and features of the patented technology.
D. Drawings: illustrate structures or details of the patent.

5. Term of Validity Period
A. Invention Patent: Renewable each year upon the end of the first year of grant up to 20years.
B. Utility Model Patent: Renewable upon the end of the first year from the submission date for application, up to 10 years.
C. Design Patent: Renewed upon the end of the first year from the submission date for application up to 10years.
