Hong Kong Patent Application

Hong Kong patent application is one way to protect your intellectual property rights in Hong Kong. A patent is a set of exclusive rights granted by a sovereign state or intergovernmental organization to an inventor or assignee for a limited period of time in exchange for detailed public disclosure of an invention. An invention is a solution to a specific technological problem and is a product or a process. The procedure for granting patents, requirements placed on the patentee, and the extent of the exclusive rights vary widely between countries according to national laws and international agreements.

Types of HongKong Patent
HongKong patent could be classified into the following two types:
A. Short-term and;
B. Standard.

Who can apply for?
Any foreign-invested company or individual is eligible for Hong Kong patent application without restriction to his or her nationality or residency requirement.

How to apply?
A. A Short-term Patent
Short-term patent application can be directly filed in Hong Kong once the specification, claims and drawings are ready. This is so irrespective of whether the document is in the format of an invention patent or a utility model. The information as below is required:
1) Applicant’s full name and address;
2) Both English and Chinese names of the new invention;
3) Inventor’s name and address;
4) Patent or utility model specification, claims and drawings;
5) Both English and Chinese version of the abstract;
6) Search report;
7) Convention priority documents (if claimed).

B. A Standard Patent
Standard patent cannot be directly applied in Hong Kong, but need first to have an invention patent application filed in or extended to China, Europe or UK, and then within 6 months of first publication of the base application, file a request to record in Hong Kong. In addition, the applicant must also file a request for grant with 6 months of the publication of the grant of patent in the base application. The information as below is required:
1) Applicant’s full name and address;
2) Both English and Chinese names of the new invention;
3) Inventor’s name;
4) Publication of the base application;
5) Both English and Chinese version of the abstract.

Renewal of HongKong Patent
A. Short-term patent: renewable after four years from filing, for a maximum term of eight years.
B. Standard patent: renewable annually after the end of the third year, for a maximum of 20 years.
