Vietnam Patent Application

Vietnam patent application can be filed through PCT (Patent Cooperation Treaty) application or directly submit the state application. At present, there are three types of patent in Vietnam, namely, invention patents, utility patents, and design patent, which is the same as China. The "first to apply" is the rule of determining the priority of the patent in Vietnam.

I. Documents required to be provided by Customer
1. Full name, address, nationality of applicant;
2. Full name, address, nationality of Patent/ Utility Solution author;
3. Name of patent/utility solution to be protected;
4. Description of Patent/Utility solution;
5. Drawings, diagram, computer mapping (if any) and so on required to make clear the content of technical solution detailed in the description of Patent/ Utility Solution;
6. The procuration compiled by Tannet with the signature and seal of the applicant;
7. Copy of the first application or documentation of already being exhibited if the application shows the request of priority right in accordance with the international treaty;
8. The Vietnamese-language version of the description of Patent/Utility Solution, protection request and summarization of Patent/Utility Solution if the application shows the content written in other languages;
9. Copy of the first application or documentation of already being exhibited, including the Vietnamese-language version;
10. Documentation of legal submission right if the submitter inherits the submission right from the other.

II. Patent application procedure in Vietnam
(1) Submitting the application
Each applicant is required to submit an application to the patent department within a twelve-month priority date.

(2) Examination and review
The formal examination is carried out within 1 month from the date of submission of the application. The feedback on the amendment of the patent application should be completed within 2 months from the date of application.

(3) Publication
The state application will be published within 19 months of the day of priority; while the PCT patent application is published within 2 months from the date of acceptance.

(4) Substantive review
The request for substantive review shall be completed within 42 months from the date of priority, and the time limit for such review is 12 months from the submission of the request.

(5) Registration
The duration of the registration period is at least 21 months, and the effective date the patent is from the date of application.

III. Validity of the Protection Certificate
The Certificate is considered effective throughout Vietnam. The Certificate of patent monopoly is considered effective from the issuance date to the end of the 20th year since the submission date. The Certificate of utility solution monopoly is considered effective from the issuance date to the end of the 10th year since the submission date.

The Certificate is considered expired in the following cases:
(1) The Certificate owner announces his/her waiver of industrial property;
(2) The Certificate owner is dead or the owner of Patent / Utility Solution registration Certificate does not operate the business any more without any legal heir.
