Registration of Industrial Design in OAPI

Industrial design is a process of design applied to products that are to be manufactured through techniques of mass production. According to Annex IV of the revised Bangui Agreement, any arrangement of lines or colors shall be considered a design, and any three-dimensional shape, whether or not associated with lines or colors, shall be considered a model, provided that the said arrangement or shape gives a special appearance to an industrial or craft product and may serve as a pattern for the manufacture of such a product.

OAPI member states are as follows:
Benin, Burkina Faso, Cameroon, Central Africa Republic, Congo, Ivory Coast, Gabon, Guinea, Bissau - Guinea-, Equatorial Guinea, Mali, Mauritania, Niger, Senegal, Chad, Togo, Union of Comoros.

What can be registered
Any arrangement of lines or colors may be registered as an industrial design in OAPI provided that the said arrangement gives a special appearance to an industrial product and may serve as a pattern for the manufacture of such product.

What cannot be registered
Industrial designs, the exploitation of which is contrary to public policy or morality, may not be registered in OAPI.

Documents required for registration
1. Name, address and nationality of applicant;
2. Identical Samples of a design, or 2 specimen size 8cm x 8 cm;
3. Description of type of goods/services;
4. Power of Attorney completed and signed by applicant (no legalization or notarization is required);
5. The Priority documents, in case of a priority claim.

Approximate timescale
OAPI takes a medium of nine (9) months from the filing date to issue the registration certificate in case all the requirements are filed at the same moment and when the file is Ok i.e. without any material error.

Terms of protection
The protection of an industrial design covers a good period of Five (5) years and its registration can be renewed twice at the end of each period of five years (total period of 15 years). But at the end of the 15 years, an industrial design can continue to benefit IP rights deriving from literary and artistic property.
